Charges dropped against cop accused of letting dog attack woman

The Ocean County Prosecutor’s Office has dismissed an indictment of a Tuckerton police officer accused of releasing his canine on a woman in custody, but said it plans to seek a new indictment.

Prosecutors on Thursday dismissed the indictment of Justin M. Cherry, 35, of Beachwood, after his attorney alleged an assistant prosecutor withheld exculpatory evidence and presented a witness who misled the grand jury that indicted Cherry, prosecutor’s office spokesman Al Della Fave confirmed.
