Man didn't get fair trial after police taped over video, judges rule

A Vineland man sentenced to five years in prison on a heroin possession charge will get a new trial because of a lost police booking room video recording.

The state Appellate Division overturned Eugene Richardson’s 2015 conviction this week, saying the jury should have been instructed to consider the impact of the destroyed recording that allegedly showed the discovery of heroin packets in Richardson’s sock.

Richardson, 30, was arrested in Vineland on May 28, 2014, following a traffic stop.
