Jersey Shore lifeguard fired at 52 gets $127K age discrimination settlement

OCEAN CITY — An Ocean City lifeguard who sued after being fired at age 52 when he failed a swim test by three seconds has been awarded $127,998 in his discrimination suit.

Paul McCracken lost his job on June 27, 2011 after the city toughened fitness requirements for all lifeguards, according to the lawsuit.

News of the settlement was first reported by government watchdog John Paff one one of his blogs, Random notes on NJ government.

McCracken, a Linwood resident, said in his suit that he passed the fitness test but narrowly missed meeting the swim requirements.
